Abstract

In the rules for the regulation of algorithms, AI and data protection, transparency is at the core of the regulations. In this paper, we analyze the content of these regulations and their importance. In turn, upholding the need for transparency regulations to ensure the exercise of the rights of working people, this paper argues that it is insufficient in the labor sphere. In this sense, it is criticized that transparency is used as a justification for not establishing new material rights to ensure the protection of workers in the face of the challenges presented by AI at work. Finally, it is proposed to reinforce these transparency obligations by means of presumptions that facilitate the exercise of workers’ rights.
