Zusammenfassung
Recently there has been a growing interest, both in theory and on the part of competition authorities, in the performance of the labour market from an antitrust perspective. In order to prevent unjustified restrictions on access to human resources, certain agreements —no poaching, no competition— are being questioned. Since labour law allows, under certain conditions, the establishment of restrictions on the freedom to work, it is necessary to consider the possible impact of antitrust rules on the awarding of service contracts.
