La incidencia de la violencia de género y económica en las donaciones conyugales

The ratification of the Istanbul Convention imposed the obligation to adopt legislative and political measures to prevent, investigate, and punish economic violence against women. To achieve this, it is necessary to analyze the regulations that economic relations between spouses from a gender perspective. In this context, this article examines the extent to which gender-based violence can be considered a cause for the revocation of donations made by women and their relatives and loved ones to the abuser, as well as the potential impact of this violence on the contractual will of women who have lived in such a violent environment. The analysis is carried out in relation to both donations made due to marriage or propter nuptias and those made during the marriage, as well as their treatment in the settlement of the matrimonial economic regime.
