Abstract

This article analyses the recent Spanish social benefit Minimum Vital Income (Ingreso Mínimo Vital, IMV) from the perspective of human rights, in particular from the standards required by the right to social assistance. The objective is to assess whether or not the IMV complies with the requirements of the right to social assistance ofArticle 13 of the European Social Charter which have been developed bythe European Committee of Social Rights of the Council of Europethrough its Conclusions. The study of the regulation of the IMV and of the demands of that right allows us to conclude that, despite the important advances already made, some improvements are still necessary, such as the coverage of young people under 23, the provision of basic social assistance for immigrants in an irregular situation and in cases of sanctions and the further development of inclusion measures. Civil society organisations and international human rights experts also recommend increased flexibility of the activation approach, the payment of the benefit in separate accounts or to the main caregiver, and the guarantee of face-to-face application mechanisms to fight the digital divid
