Resumo
The article conducts a study of the legislation in force in Spain on the legal treatment of animals, theri concept, nature and the various legal relationships in which they can be found. From this background we analyze the text of lege ferenda in the proposal of Law 122/134 of october 13, 2017 that represents a radical change in the concept and consideratiion of animals in our legislation, becoming one of the most advanced of the Western democracies. The Proposed Law is systematically analysed by enhancing its legislative progress, considering the overall theatment of animal welfare as a premise and assessing the gaps that would still remain in the legal system for full recognition and absolute protection of the animal.
