Zusammenfassung

The 115/2008/CE Directive on common rules and procedures in Member States for the Return of third country nationals in an irregular situation is known, in general, as the “Directive of Return”. It lays down common measures for the States of the European Union (although not all are included) on the procedure for return of third country nationals which consists of two phases: the voluntary and forced return. We carry out an analysis of the origin, the principles and the basic contents of this Directive, that challenges some fundamental rights relating to effective judicial measures, periods of confinement or protection of minors.
