Abstract

In this paper we analyze from a qualitative approach the discourses on gender violence by professionals of the legal-criminal field. Our focus is to ponder and evaluate those most problematic issues that arise in the treatment of domestic violence in relation to the criminal justice system, the implementation of the Law, with particular reference to the prohibition to approach the victim, considering the barriers that hinder their application and effectiveness. This qualitative study is based on in-depth interviews with key informants, using the Social Discourse Analysis as a method to analyze and interpret the data, specifically through the identification of interpretative repertoires. Results show that legal operators maintain a similar discourse, typical of the legal community, characterized by a scientific and professionalized discourse, which is missing a look from women, nearer to them, open to empathize with victims and take into account their subjective experience.
