Abstract

Within the Spanish Social Security system, the contingency of «old age» is protected through the retirement pension. Provision in which the age of the worker has a decisive impact on his incardination in public protective action. Historically, the determining age of the right to a pension has remained in the 65s, but our country‘s structural changes have resulted in the need to raise, even on a transitional basis, that age, with the interest of fostering prolongation of working life and delayed access to retirement protection. However, the reality is that today it is still possible to qualify for a retirement pension without having reached the ordinary age through the different forms of early retirement (voluntary or not, for workers at risk, for people at risk disabled, or for workers who have been affiliated with defunct social protection schemes) or in the term of office. The objective of this study is to analyze the age requirement necessary to achieve the right to the retirement pension, and, at the same time, to explore the possibilities that the current legislation, interpreted by the employment jurisdiction, reflects as causes of advance of the retirement age.
