Abstract
In order to alleviate the bad situation that the coastal fishing economy countries are experiencing, there has been since a long time a growing interest to create a legal framework allowing new professional opportunities to be incorporated into the world of fishing, through the diversification of activities that, combined, would contribute to the enhancement of the fishery product and its profession. The European Community has promoted this path and now it is up to each State to delimit the legal bases for making this new activity, fishing-tourism, a sustainable product that comes to stay, with a regulation enabling safety in navigation and a legal framework contributing to its correct and easy implementation and where the interests of the different stakeholders are present: professionals of the sea, public administrations, Local communities and users. A regulation has been recently issued at state level that finally delimits the basic conditions for the exercise of this activity that had been already subject to regulation at regional level by some of the coastal Regions interested in this project, which fosters and requires a legal-administrative analysis and assessment of the new legal framework.
